Terms and Conditions Medibooking  

1. General                        

I. These Terms and Conditions (hereinafter referred to as “Terms” or “Agreement”) apply to the use of the MediBooking website, medibooking.com (referred to as “We”, “Us”, “Our” etc.) offering services to individuals (referred to as “You”, “Your”, etc.).                      
II. The terms below are the only terms; any general clauses conflicting from our terms will not be accepted. By using Medibooking you are agreeing to the terms set out in this agreement applying best efforts to comply with this agreement. At any time during the use of our site you do not agree to the terms please discontinue the use of the site.
                   
III. We reserve the right to changes to the terms without your knowledge from time-to-time, it is your responsibility to keep up to date with the terms in this agreement.
                    
IV. We will not be storing the contractual terms for your use.
 
2. Scope of Services                        
I. Our services are an Internet platform that specifically provides services to patients who seek treatment in hospital clinics or other health services around the world. Our platform holds information on hospitals contracted with us, medical treatments offered, and the suggested physicians in their respected fields which allows you to identify the health facilities that provide you with the services you need.                      
II. Upon request we contact the facilities based on the information you provide, which we have already researched and selected, to provide you with information on the facility, procedure, providers, and costs for the medical service requested by you.                    
III. We are not a medical facility, meaning we do not provide you with medical services and are not liable for the accuracy of medical information shared by you or any health service providers, we transfer information from you to the health service providers and vice-versa.                     
IV. Information provided on our site on hospitals and providers was obtained from the hospitals or providers themselves or by gathering information from reliable sources. We work to insure the information we provide is as up to date as possible. Medibooking, however, cannot be held liable on the accuracy of the information provided on the hospitals and providers.                       
V. Our services are free of charge to you, we are compensated by the health service providers whom we are contracted with. However there are options of requesting for additional services, incase you ordered additional services a confirmation email will be sent to you to confirm the additional services requested. Agreement to the additional services is binding and you are responsible for the payments of the additional services.  
3. Conditions of Use                        
I. To agree to these terms you must be at full legal capacity and be at least 18 years of age.                II. When submitting information to health service providers, or us the statements must be accurate and complete.                    
III. If at any time during your process with the heath service provider, or us your information or medical situation changes you are to inform us to update our files on your case.                     
IV. By submitting your information to us you grant us permission to use this material to the extent required to provide you the services you need and agreed by you. Agreeing the above term allows us to share this information with the health service providers in order for us to be provided with accurate information on the procedures and costs you will endure.                       
V. Once a request is submitted you will automatically have an account created for you. This personal account may be used for provision to information in your file, you can also upload your medical records directly onto your account and will have access to the providers, where you can choose the preferred one for your treatment.  
4. Limited Liability                        
I. We are only liable for damages incurred by you due to negligence from our employees or agents resulting in death or injury.                     
II. We do not make promises on the services rendered by us and we do not provide any guarantees on the services.                    
III. By using our site you agree to its terms and are explicitly confirming that you understand and take full responsibility and assume all risks direct or indirect resulting from the use of our services.            IV. We, as well as our shareholders, partners, and agents are not liable for loss of information, profit or financial losses due to failure or shutdown of the website. We are not liable to up to date information provided by providers or health service facilities or any third parties on our site.                       
V. Throughout Medibooking there may be links to third party sites, which are including on the site for your convenience, however we are not liable for the information provided on the third party sites.  
5. Data Protection                        
I. In order to for us to provide you with the services you need we require certain information to be shared by you, including but not limited to private, sensitive, and specific information. We respect the confidentiality of the information you provide us, however we cannot grantee a perfect way to securely share the information online, we do our best to insure it is not shared anywhere else. For more information please read our Privacy Policy, we strongly advise you to be familiar with both documents.  
6. Concluding Provisions                        
I. The terms are governed by German law to the exclusion of the rules on the Convention on the International Sale of Goods (CISG) and the rules for conflicts of laws.                     
II. The courts of Berlin will have exclusive jurisdiction on any disagreement arising on or in correlation with these terms.                    
III. You conclusively submit to the jurisdiction of the courts of Berlin.                     
IV. The terms embody the entire agreement between you and us in relation to the use of or website and our services. Neither party shall be held responsible for a delay in services if the delay is due to an unforeseen event such as fire, flood, explosion, war, embargo, government requirement, civil or military authority, or other causes beyond our control.                       
V. If parts of the agreement become ineffective that does not mean the agreement as a whole is ineffective, and it does not result in a waiver of rights if we fail to enforce any of our rights.       
VI. You may not transfer or assign any or all of your individual rights or obligations under any contract with us.                   
VII. Any notice by you must be given in writing to the address on the website.
